What the regulator announced

The Florida Office of Insurance Regulation (OIR) said Infinity Auto Insurance Company will refund more than $46 million in excess profits to consumers within 60 days, according to a state bulletin dated Nov. 2, 2026. The profits cover the calendar and accident years 2023, 2024 and 2025.

Insurance Commissioner Mike Yaworsky said in the bulletin that “Insurers must act in the best interest of Florida consumers,” and he credited the company for “providing data promptly to the Office of Insurance Regulation.”

How excess profit refunds work

Under Florida law, insurers must return excess profits if underwriting gains for the three most recent calendar-accident years combined exceed the anticipated underwriting profit plus 5% of earned premiums for those years, the bulletin says. The bulletin cites Section 627.066, Florida Statutes.

What the regulator says comes next

The commissioner said other auto insurers are approaching the statutory threshold and that he expects “more announcements of refunds for Floridians in the near future.” The OIR said it is reminding other auto insurers of their obligation to return excess profits when applicable.

What the notice does not say

The bulletin does not say how many policyholders will receive refunds or how much each one will get. It does not say whether refunds are automatic or require a claim. It does not name any county or metro area.

Infinity will try to locate policyholders whose refund checks are returned. If it cannot reach them, it will report the unclaimed funds as unclaimed or abandoned property under Chapter 717, Florida Statutes, the bulletin says.
